Consumer Protection Law Framework in India

Overview of consumer law in India, including the Consumer Protection Act, 2019, key definitions, scope, consumer rights, goods and services, and the three-tier consumer redressal structure.

The Consumer Protection Act, 2019 replaced the 1986 Act. It provides for District, State and National Consumer Disputes Redressal Commissions, the Central Consumer Protection Authority and product liability.

Consumer Rights, Consumer Complaints & Remedies

Consumer rights, filing of complaints and available remedies.

Complaints may seek remedies such as replacement, refund, removal of defects and compensation, as provided in Section 39 of the Act.

3

Deficiency in Service & Consumer Service Disputes

Deficiency in services, including professional, insurance and utility services.

'Deficiency' is defined in Section 2(11) as any fault, imperfection, shortcoming or inadequacy in the quality, nature or manner of performance of a service.

4

Defective Goods, Quality & Warranty Disputes

Defects in goods, quality issues and warranty-related disputes.

'Defect' in goods is defined in Section 2(10). Complaints may seek replacement, repair or refund, depending on the facts and any warranty terms.

Unfair trade practices are defined in Section 2(47), and the Central Consumer Protection Authority can act against misleading advertisements.
